Pool Fence Rules in Ontario: Height, Gates & Permit Requirements

Last updated: June 2026

In Ontario, any pool with water 0.6 metres (about 2 ft) deep or more must be fully enclosed by a fence at least 1.2 metres (4 feet) high, with self-closing and self-latching gates. These pool-enclosure rules are stricter than standard fence bylaws and are tied to the Ontario Building Code and municipal pool-enclosure bylaws. In Kingston, a pool fence requires a permit from the City. Non-compliance is a safety and liability issue and can affect your home insurance, so pool fencing should be treated as a separate compliance check from your regular fence.

How tall does a pool fence have to be in Ontario?

At least 1.2 metres (4 feet) high. Some municipalities require taller — Toronto, for example, requires 1.5 m — so confirm your town's pool-enclosure bylaw. The self-closing/self-latching gate requirement applies regardless of height.

What are the gate requirements for a pool fence?

Pool-enclosure gates must be self-closing and self-latching, so the gate returns to a closed, latched position on its own — a child should not be able to leave it open.

Do you need a permit for a pool fence?

In many Ontario municipalities, yes. In Kingston specifically, a pool fence requires a permit — you submit an application with the fee and plans showing the pool's location.

See the full Kingston fence bylaw guide for details.

When does a pool need a fence at all?

Once the water is 0.6 m (about 2 ft) deep or more, full enclosure is required — this captures most in-ground and many above-ground pools. Above-ground pools can sometimes use a fence mounted to the pool wall (min 0.3 m) plus a compliant enclosure; check the local bylaw.

How much does a pool fence cost?

Pool-enclosure fencing typically costs 10–20% more than a standard fence because of the height and gate-hardware requirements. Budget accordingly on top of the per-foot ranges in the main cost guide.
