Do You Need a Permit to Build a Fence in Gananoque? (What the Town's By-laws Say)
Last updated: October 21, 2026
You do not need a building permit to put up a fence in Gananoque, except around a swimming pool or hot tub, which does need one (Town of Gananoque building page). Height is the part to check. The Town's zoning by-law says a fence must follow any fence by-law the Town has enacted, or the Line Fences Act, and we could not find a general residential fence by-law with height limits on the Town's by-law list, only one for pool fences. The limits we can source are 1.0 m on corner lots (in the sight triangle) and 1.2 m minimum around a pool. Call the Building Department before you build.
Do you need a permit to build a fence in Gananoque?
For a regular fence, no. The Town's building page lists fences among the work that does not need a building permit, with one exception: fences around swimming pools and hot tubs, which do. It also says zoning by-laws still apply, and that building without a required permit can mean increased fees.
How high can a fence be in Gananoque?
We could not find a residential fence height limit in the Town's published by-laws, so this guide does not give one. Here is what we checked on October 21, 2026:
- The Town's Development Permit By-law, which is its zoning by-law, says in section 3.16 that any fence built in the municipality must follow any fence by-law the Town has enacted under the Municipal Act, or the Line Fences Act. That section sets no fence height of its own.
- The Town's by-law list shows one fence-related by-law, 2011-075, which covers fences around swimming pools. It shows no general fence by-law and no line fence by-law.
- The building page says fence by-law restrictions still apply, but it does not list them.
That leaves a gap we cannot fill from the Town's documents. Before you build, ask the Building Department what applies to your lot and get the answer in writing: (613) 382-2149 ext. 1132, cbo@gananoque.ca, 30 King Street East, 8:30 am to 4:30 pm Monday to Friday. Give a copy to your contractor.
Do not borrow another town's limit. Brockville and Kingston set heights in their own by-laws, which do not apply in Gananoque. Our Brockville fence permit guide and Kingston fence bylaw guide show how those towns do it.
What is the fence rule on a corner lot in Gananoque?
On a corner lot the zoning by-law (section 3.43) keeps a triangle near the intersection clear so drivers can see. A fence, tree, hedge or bush in that triangle may not rise above 1.0 m over the centrelines of the abutting streets.
| Rule | Limit |
|---|---|
| Fence, tree, hedge or bush inside a sight triangle | Top may not exceed 1.0 m (3.3 ft) above the centrelines of the abutting streets |
| Sight distance in residential designations | 4.5 m (14.7 ft) along each street line from where the street lines meet |
| Sight distance for apartment buildings, and in commercial and industrial designations | 15 m (49.2 ft) |
| Finished grade inside a sight triangle | No more than 0.5 m above the centrelines of the abutting streets |
The triangle is formed by the two street lines and a third line joining points that are each one sight distance from the corner.
What are the rules for pool and hot tub fences in Gananoque?
These are the one set of fence rules the Town has written down, in By-law 2011-075 and on its Pools & Hot Tubs page:
- Permit first. A permit is needed before you install a pool, hot tub, spa or similar structure that can hold 460 mm (18 in) or more of water, including decorative ponds. The enclosure and gates must be in place before water goes in.
- Height. The enclosure must be at least 1.2 m (4 ft) high. Pool walls at least 1.2 m above grade can serve as the enclosure, but a compliant enclosure is still needed around the access.
- Gates. Self-closing and self-latching, and kept locked when a responsible person is not supervising.
- Openings. No opening may let through an object larger than 100 mm (4 in) across.
- Hot tubs. A lockable lid that stays closed and locked when not in use, unless the tub is inside a compliant, locked pool enclosure.
- Location. Pools are generally allowed in rear yards. A pool on a corner lot may need approval from the Manager of Planning.
Applications go through Cloudpermit, with fees based on the project's estimated value. For the provincial picture, see our Ontario pool fence rules guide. Gananoque's own by-law is the one that governs.
Who owns and pays for a fence on the property line?
Gananoque's zoning by-law points to Ontario's Line Fences Act for boundary fences. Talk to your neighbour before you build. Our guide to who pays for a shared fence explains cost-sharing, fence-viewers and how disputes are handled.
